1. Who we are
Sparky is operated by ThinkBuddy AI ("we", "us", "Sparky"), a business entity. By using Sparky, you are entering into an agreement with ThinkBuddy AI. You can reach us at support@kidschatapp.live.
2. Acceptance of Terms
By using Sparky, you agree to these Terms of Service. Sparky is a kids' AI chat service designed for children under parental supervision. Only parents or legal guardians may create and manage accounts, and you must be at least 18 years old to do so.
3. Parental Consent & Account Creation
Parents create the account, manage child profiles, and control settings. By creating a child profile, you confirm you are the parent or legal guardian and have authority to consent on the child's behalf. You are responsible for keeping your account credentials confidential and for all activity under your account.
4. Acceptable Use
- Sparky uses AI to generate responses. While we enforce safety moderation, no AI system is perfect. Parents should supervise usage.
- Do not use Sparky for any unlawful purpose, to generate or share illegal, harmful, abusive, or infringing content, to attempt to jailbreak or bypass safety filters, or to interfere with the security of the service (including scraping, probing, or distributing malware).
- Do not reverse engineer, resell, or redistribute the service or its outputs.
4a. AI Content, Inputs & Outputs
- Prohibited use of the AI: you and your child must not use Sparky to generate or solicit illegal content, sexual content involving minors, hate speech, harassment, self-harm encouragement, violent extremism, deepfakes, malware, or attempts to jailbreak or bypass safety filters.
- Responsibility for prompts and outputs:parents are responsible for the prompts submitted under their account, for how outputs are used, for verifying the accuracy of any output before relying on it, and for ensuring they have the rights to any content they input.
- IP in inputs and outputs: you retain rights in the content you submit and grant us a limited license to process it to provide the service. Subject to applicable law, you may use AI outputs generated for your account for personal, non-commercial family use. If you believe an output infringes your rights, email support@kidschatapp.live with details for a takedown review. Repeat or serious infringers will have their accounts suspended or terminated.
- Moderation rights: we may filter, refuse, or remove inputs and outputs, restrict features, and suspend accounts to enforce these terms or protect users.
- Accuracy disclosure: AI outputs can be incorrect, incomplete, or inappropriate. Sparky is not a substitute for professional medical, mental health, legal, educational, or financial advice. Parental supervision is required.
5. Subscriptions, Payments & Refunds
Payments are processed securely by Stripe on behalf of ThinkBuddy AI. Payment, billing, and tax mechanics are governed by Stripe's Consumer Terms. For billing or refund questions, contact us at support@kidschatapp.live.
Subscriptions auto-renew at the end of each billing period unless cancelled. You may cancel at any time from your account settings. We offer a 30-day money-back guarantee — see our Refund Policy for details on how to request a refund.
6. Intellectual Property
Sparky and its content, software, and branding are owned by ThinkBuddy AI and protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable right to use the service for personal, non-commercial family use within your subscription plan. You may not copy, modify, or distribute our software or branding without permission.
7. Service Availability & Disclaimer
Sparky is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free, or that responses will always be accurate or appropriate. Parents are responsible for supervising their child's use.
8. Limitation of Liability
To the fullest extent permitted by law, Sparky shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill) arising from use of the service. Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. Nothing in these terms limits liability for fraud, death, or personal injury where such limitation is prohibited by law.
9. Suspension & Termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time from the Parent Dashboard.
10. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email or in-app notice. Continued use after changes take effect constitutes acceptance.
